Does an HOA in AZ REquire Using a Management Company?
Hello,
Our 65 home HOA has no pool/amenities/greenways. We have 6 – 20ft common areas with 1 irrigation system which needs annual certification. Do we legally have to have a management company? Can we self-govern? The home owners are looking to remove the management after dismal performance over 2+ years (new build development). I’ve called AZ Corp Commission, searched extensively to find laws; read our HOA docs to no conclusion. Any clarity or pointing me to a solid resource would be appreciated.

You have absolutely no requirement to have a management company. In fact, only about 65% of the more than 9500 associations in Arizona are professionally managed. The association that I live, is self-managed, and is the best community that I’ve lived in in Arizona or anywhere else.
The association still has to keep books and records and manage the money but how the board wants to deal with the homeowners is up to the board itself. This is in fact always the boards responsibility but with a management company far too many boards forget that and let those bozo’s run the show.
Please remember that the law applies equally to self-managed associations and professionally managed associations alike.
