Current Year HOA Legislation

HOA laws: Who influences the Legislators?

The HOA Industry; Management Companies, Attorneys, Collection agencies, and service providers draw most if not all of their income from HOA Associations. These Associations have mostly unlimited ability to assess their homeowners for any and all their cost. The HOA industry is represented by three primary trade groups:

  • CAI:        Community Association Institute a national organization
  • AACM:    Arizona Association of Community Managers
  • HBACA:  Home Builders Association of Central Arizona

Every dime that circulates thru the HOA industry comes out of the pockets of the 3.5 Million Arizona Homeowners. 

Have you ever wondered why there is only one law firm in Arizona that exclusively represents homeowners, while there are hundreds if not thousands of attorneys that exclusively represent the HOA/Condo associations and builders?

Its about the Money

With that money comes paid professional lobbyist representing the HOA Trade groups, special events for legislators, and contributions to political campaigns.  The voice of these trade groups is very well heard at the Capital.

Despite this Arizona has been blessed with individual homeowner advocate pioneers, who worked hard to fight these trade groups and get laws passed to help protect your rights, one small step at a time. It was on the shoulders and hard work of these pioneers that the Arizona Homeowners Coalition was formed.

True reform and protection of homeowner’s rights in these common interest communities will only be achieved by the collective voice of 3.5 Million homeowners demanding that protection by their government.

SB-1246  : HOAs; Foreclosure Process [Strongly Support]

  • Senator Hoffman totally gutted the bill based on input from only AACM and CAI, totally ignoring the impact to any homeowner. This bill will now only apply equal protection to Condominium owners on foreclosure threshold and now also address special assessments greater than the monetary threshold of $10,000 for either.
  • Status : Passed Senate sent to the House. Passed Government & Rules Committee awaiting COW.

HB-2397: Property Covenants; Disclosures [Strongly Support]

  • Totally gutted based on demands from the HOA trade groups and converted to only a Resale disclosure Bill. This bill represents the fulfillment of Jill Schweitzer’s dream before her passing. None of you will ever realize the ten years of work and how difficult this legislation was to get to this point based on endless opposition from AACM, CAI, Builders and even the Realtors.  Home buyers will finally be given the information they need to make an informed decision to buy in these communities. Now all they have to do is actually pay attention and read it. More work is needed to address the fee charged for this disclosure service which is the highest in the country, that was too large a battle to be addressed in this bill.

SB-1290 Striker : HOA’s Closed Meeting Action, prohibition [Strongly Support]

  • This two word strike everything amendment to a totally unrelated bill “Agricultural Property; inspection; notice”, will once and for all prevent association boards from taking any action on any issue in closed sessions, which has been the law already for 31 years. All HOA attorneys and both CAI and AACM have trained community mangers and boards since 1994 when the open meeting laws were first introduced that “consideration” meant that they could also vote on any issue. The truth has always been that it does not and they lied to every board since then. We will amend this striker from the House floor to also apply to Condominiums. While this is the simplest possible legislation (2 words) it may be the most consequential to protect transparency for every homeowner. 
  • Once a strike everything amendment is passed it never has to go to a committee again and no committee chairman can keep it from being heard. It will go before the entire House and then return to the Senate for a vote by the entire Senate. As you can imagine this bill is vehemently opposed by both AACM and CAI because it exposes their lies, They will stop at nothing to kill this bill and we all need to work together to protect it.
  • Status: Passed House Commerce & Rules Committee, awaiting Cow.

HB-2342: HOA’s; Shade Structures [Strongly Support]

  • This bill will prevent any Planned Community from restricting the use or installation of any shade structure, with a broad definition of shade structures. Very useful legislation.
  • Status: Passed Both Chambers. Returned to the House to consider Senate Amendments.

HB-4011 : HOAs, duties  [Support]

  • This bill is a  limited attempt to establish that the associations must act reasonably in the application of discretionary powers. (Rule Making, Design Control, and Enforcement) While I’d  prefer a stronger statement and more accountability for compliance of this provision, it is at least a start and more then we have right now. Every other bill addressing this issue was killed. Very weak.

SB-1582 Striker : Planned Communities Pets and Chicken ownership limitations [Support] 

  • This strike everything amendment to an unrelated bill resurrects HB-4017 and adds provision protecting ownership of backyard chickens. This bill is well structured and addresses behavior and potential nuisance based impacts to adjacent properties, and other property owners, consistent with and identical to existing limitations for any municipality. 
  • Status: Passed House Appropriations Committee, awaiting COW & 3rd Read

SB-1184: HOAs; Uniformed Services Divisions Flags [Neutral]

  • This bill is another Whack-A-Mole Flag protection bill. Very limited value, and the wrong approach to the issue. While all military service flags are already protected this bill protects division level flags. Politicizes HOA Flags as witnessed by an attempt to include Pride Flags in a hostile COW amendment by Democrats. Risk veto by the Governor.

SB-1808 HOAs; Allied Countries’ Flags  [Neutral]

  • This bill is another Whack-A-Mole Flag protection bill. Very limited value, and the wrong approach to the issue. Many questions will arise as to what constitutes an allied country, as alliances often change.
  • Status: Passed Senate and sent to House. Passed Government & COW Committee, awaiting 3rd Read. 

SB-1431: Municipalities; planned Communities; design; prohibition [Neutral]

  • This bill applies very detailed restrictions on what a municipality can demand from any developer building a planned community, but places no restriction on the Developer applying those same restriction to any home in the community on their own. This was driven by the developers for the developers and has no real value to any home buyer or does anything to reduce the cost of home ownership. This legislation demonstrates the power of the developers at the legislature, but if the legislature was truly interested in reducing the cost of housing, or increasing the supply of housing in this state the provision of this bill would apply to the developers as well and make a significant change in the entire HOA world. May look to capitalize on this bill if made into law next session.

SB-1378: Political signs; homeowner’s associations [Support] Signed into Law 5/2.

  • This bill prevents an association from restricting the use of a political flag as well as a political sign during election cycles. 

SB-1494: Common expense liens; foreclosure; amount [Support] Signed into Law 4/18.

  • This bill revises the Planned Community foreclosure threshold from one year or $1,200 to eighteen months or $10,000. Does not apply to Condominiums.  Will have to get that next year.

HB-2322: Condominiums; commercial structures; residential structures [Support] Signed into Law 4/7.

  • This bill applies to condominiums that have separate commercial structures and allows for the separation of common expenses between the occupants of the residential and commercial structures.
