Request for Financials
I live in a planned community. Our community website at one time posted monthly Revenues and Expenses statements. A couple of months ago, I noticed they were removed. During our monthly open meetings, the Treasurer’s report is scrolled through very quickly, unable to discern anything (we are still holding Zoom meetings). Recently I sent a request to our Community Manager for copies of the approved 2022 Budget, and Revenues and Expenses statements for January through July citing
A.R.S. 33-1805. A week later, I followed up with a friendly reminder for the financials outlined in my request. I have had no response. At this point, I’m not sure how to proceed and what options I have.

You are absolutely correct you are entitled to the financial statements that you requested under Arizona law and the specific statute that you quoted, the association has 10 business days to provide you access to the requested information and if you want a hard copy, they can only charge you $0.15 per page. I would send then a quick note reminding them when the 10 days expires and inform them that if they do not provide you access to the requested documents they are violating the law and you will be forced to file a petition with ADRE and an Administrative law judge will force them to comply with the law under penalty of contempt of court and they will be forced to pay you $500 filing fee. They can provide the requested records willingly or face the consequences. It is their choice.
