ARS 33-1805

In accordance with ARS 33-1805, I requested all year-to-date financial records related to legal fees including but not limited to all invoices related to all legal services rendered to the HOA for the 2022 calendar year.

The property manager says the HOA attorney has disallowed my request as it is “attorney client privilaged information”.

Is this accurate?

    Dan,

    The attorney is full of crap as usual. You are not looking for any advice offered by that attorney only the record of the billings he provided to the association. As such those billing are financial records of the association and subject to records request. Actually, the attorney has absolutely no say in this matter it is an association record and under the referenced statute subject to records request. The association has 10 business days to provide you access to the requested material or violate the law.

        Any and all violation of community documents is public information and neither personal or financial information. So if anyone does not pay their assessment that is public information with no expectation of privacy. That failure to pay assessment negatively impacts every other homeowner in the community that will ultimately have to make up for that deficiency.
