Co-op vs condo
Hi Dennis,
We are a co-op and having difficulty finding an attorney who understands a co-op in Arizona. Any ideas?

You are a very rare bird, there are to my knowledge less than a dozen co-ops in this state. Co-ops are a common interest community like condominiums and planned communities but there are no state statutes addressing that ownership model. We do have Title 33 Chapter 20 that applies to time-shares which are a form of Co-op. All time shares are co-ops but not all co-ops are time shares. As for attorneys it depends if you are looking for an attorney to represent the owner of the property or the occupants. As you are probably aware as an occupant you have no ownership right to any of the property, you paid for the right to occupy a unit and pay assessments to manage the association and maintain the property. You are the opposite of a condominium where the association owns nothing, and the unit owners own everything.
