Violating HOA Campaign Specific-Election Policy
Dennis – what would think about a HOA President that violates the very policy she voted into HOA adoption? The language was very specific when the policy was drafted and passed by the board as to when the HOA specific election campaign signs can be deployed and where. HOA common areas are not to be used – residential yards only. Unfortunately no repercussions were drafted into the policy, unless you can point out indirect AZ election laws that would apply? Even sadder is one of the other candidates is following along. In-addition one of them is a register user on your site and posed a question a while back.

When the board adopts a policy, it is bound by it as is any other member of the community. While I’ve no idea what your policy actually says, I do know exactly what the law states relative to community-specific political activity because I wrote it, negotiated it over dozens of hours with all the other trade organizations, and then sold that legislation to both houses of the Legislature. No matter what your policy says, the state law trumps it if it differentiates in any way from the law.
