Picture or Video of Documents Viewed during Records Request
Can the Management Company Stop you from videotaping or taking pictures of Documents that you are viewing during a records examination appointment? Our Management Company has that restriction in their Contract.

This is simply another example of community manager greed, where they bury a clause in their boilerplate to generate more revenue. The law allows you to view any document without charge, and then will enable you to purchase any record for $ 0.15 per page. Your phone is your property, and you are free to use that property any way that you want, including to take pictures of documents. The management company has no contract with any homeowner, only the association, and the association has no authority to dictate what you do with your personal property. While the record is the association’s record, if you are allowed to see it, you can photograph it.
That clause violates your constitutional right to private property use.

This is great to know! I’m up against some ridiculous evasive maneuvers for very simple records requests and am planning on bringing a portable scanner with me because I have a feeling they will try to limit my time. I just can’t understand the need to hide documents if they aren’t doing anything wrong. Seems so petty and odd.

Nothing about these community manager and attorneys surprises me anymore, and none of it is good. Until we can get better clarity and accountability in the law, they will leverage any possible excuse for not doing their job or to twist and distort the law in any way they want. That is why my work with the legislature is so critical to all homeowners in these communities. Until we can get the legislature to listen to their constituents and protect them from these vultures that only want your money nothing will change for any homeowner in this state.
