Appeal Process

Hello,
I received a fine, and appealed through the AAM website(I still have the link which shows confirmation). One month passed, and I received another fine. I inquired why am I being fined without having an appeal and the community manager rescinded the fine. The community manager knew my issue and said she would let the board know. I thought I had a right to have an appeal heard in an open forum in front of the board of directors? I have no idea what the community manager sent on my behalf, when it was seen, or by whom it was seen. I was just told my appeal was denied and sent a letter. Was this process right? I stated I wanted to meet with the board but that never happened. My community is developer run for full transparency. Thanks.

    Joseph,

    Whether you are under declarant control or not the law applies the same to both. You appeal was to the board of directors, and you were entitled to be heard at an open meeting of the board on the issue. The meeting option of open or closed is at your discretion only not the boards. The association cannot apply any fines until the opportunity to be heard is satisfied under Arizona Law. They can either comply with the law, and allow you the opportunity to be heard on your appeal or they can face an administrative law judge that will force them to comply with the law.

    Thank you for the response. I am sending a certified letter to the management company again stating my desire to have a meeting with the Board, in spite of them “denying” my original appeal without a meeting.
