Security Cameras
Hey Dennis,
We have certain homeowners who don’t like our security cameras and have told us that they intend to cover them while in the clubhouse. Isn’t this “tampering” and is it not illegal?

Are you a Condo or a planned community? As long as the security cameras are truly established as security features and not for observing quest, you absolutely have the right to install those cameras and to keep them functional and the upset homeowners have absolutely no right to cover them. Inform the entire community that the cameras are installed for everyone’s protection and are not to be tampered with. Doing do will be dealt with. The reason i asked about the type of community you are in is because of the ownership rights for the common property are different between the two types of communities. If the abuse and tampering continues, you are free to establish rules relative to use of the community property that cauld be restricted to anyone tampering with the security cameras.

Thanks, Dennis. We are a planned community. I have another question related to this. We are not saving recordings – they are over written about every 5 days or so. No recording is being saved on any device anywhere. Are the recordings subject to 33-1805? I can foresee those certain homeowners mentioned above making requests to view the recordings or somehow request copies.
We have drawn up a policy but instructed by our atty not to use the word “security”. She also urged us NOT to use cameras at all.
We’ve had many problems at our pools/clubhouses where people block open gates and climb walls to get in and either swim or otherwise use the facilities. These people obviously do not have keyed access to either the clubhouses or pools. I’ve been phoned at midnight by a homeowner telling me that someone climbed into one pool area. It took me about 15 minutes to get there and he was still there and told me he needed a drink of water, all the while getting undressed. The next day we found a backpack and bolt cutter on the roof of that clubhouse.

While not an attorney I cannot see how these temporary recording could be considered records of the association subject to 33-1805. The arguments from your attorney are total BS. If they cameras are not security features, then they are surveillance features, and the association has absolutely no right to surveil the inhabitants of the community. They do have the right to install security cameras to protect the residents.
