Single Service Waste Provider

After 23 yrs of individual choice, my HOA is considering CCR “The Association may require that a single garbage or refuse service be employed by all Owners, and may also include the cost thereof in the Annual Assessments”. There is no Annual Assessment now nor does the HOA intend to start one and be the contractor. Rather, the HOA intends require residents to contract with and pay the selected single waste disposal service as individuals. I oppose the move for a variety of reasons and wonder: “Can they do it? That way? Any recourse other than complaining, organizing & electing new board members in the future?”

    Ron,

    As you implied the only way to do this is with a modification to the CC&R’s. When they try this just cay and vote no. and work to get enough of your neighbors to do the same. while there may be some economies of scale that could be applied by this plan it is fundamentally giving the association the right to charge everyone whatever they want for this service. Pay for your own service and retain the freedom to choose what is best for you. Never give the association more power or control over you or your home.
