Detailed Delinquency Report

Hi Dennis,
Our Association’s CC&Rs state that the Board may suspend voting rights of members if the member has any past due assessments, fines or open violations. In last year’s election they spelled this out on the ballot and clearly stated that any past due balance would invalidate their ballot.

I am doing an audit of our election and want to know if I can request a copy of the detailed delinquency report that shows all delinquent homeowners as part of this request pursuant to 33-1812(A)(7) without them denying it under 33-1805(B)(4).

I did a cursory audit in the management company’s office and discovered a large number of discrepancies in the election and the management company that was running the election has since quit.

    Amy,
    I would approach it this way. Do a request to see all ballots received that were deemed to be not eligible to vote for any reason. If you go for a delinquency report you could be denied based on the financial record aspect of the report.
