Pictures of association records

Dennis,

While viewing association records pursuant to ARS 33-1805, can an association or community manager prohibit the member from taking a picture with their cell phone of an association record for their own personal record?

I would have thought this is no different from when an association emails you a record that you requested pursuant to ARS 33-1805 or when they place the records on their portal for members to download. Once downloaded, it is the member’s, for his or her own personal use.

Also, is there an easy way to search archival Q&A on this portal? I would hate to ask something that’s already been answered by you.

    One more thing…. they wanted to charge 25 cents/page for any copies. I thought the law in 33-1805 was 15 c/page. Has that been updated to 25c/page? If not, can they override that law like that with their contract (which says 25c/page)?

    There is nothing in law that would allow any association from prohibiting the photographing of a public record of the association requested legally. I strongly recommend that practice to anyone that ask.

    The web site has a google search feature on the bottom of the home page that will allow anyone to search all site post based on key words.
