hoa fees

hoa fined me for violations that i wasn’t aware of we never received any letters which is the process before they move on with fines. we submitted letters asking about the issue and no response

    Benny,
    The law is clear you must be notified, the notice must identify who observed the violation and the day and time it was observed and the specific provision in your community documents that was violated. You must also be notified how you can contest the violation and request a hearing before the board of directors in either open or closed session at your discretion. They must also notify you of you ability to petition the Dept of Real Estate to contest the violation.
    All of this is specified in law and is the same whether you live in a condominium or planned community. This entire process must play out before any fine and penalty can be applied.
