Request HOA board member letter of resignation from HOA

Hi Dennis,

As always thank you for your help. When a HOA board member resigns from a HOA board, I assume this is documented somewhere, such as a resignation letter. Am I allowed by Arizona law ARS 33-1805 to request a copy of all HOA board members resignations, or would that be considered confidential?

Also, if you dont mind me asking, if someone resigns from a HOA board would that be listed in the meeting notes? Or would that be considered executive session and not documented in the meeting notes?

    Sunny,
    Officially the resignation letter from a board member is a record of the association subject to records request. Whether the association provides that information may depend on what is said in that letter. While the board may withhold that information you can always ask the individual board member if he is willing to share that letter. I really do not know how the courts would rule on this specific record.
