Trail cameta
We live in a condominium and constantly have to fight with our board of directors.
Sunday we noticed a trail camera strapped to a tree in the grass area behind our unit. This is an area where children are playing.
This was never talked about in an open meeting or voted on, and no notice sent out to the community
A resident with a minor child, who discovered the camera, has filed a complaint as she was never notified and is not allowing her child to be videotaped without permission.
One of the lenses on the camera, it has 4, is also pointing right into her living room.
Is it legal to secretly putting up cameras around the community?
One of the board members says somebody is vandalizing the landscaping. They know who it is, but want to catch the person in the act.

All homeowners have a constitutional right to privacy and the association has no right to violate that privacy. The association has a duty to protect the homeowner from treats and security cameras are a means to ensure that protection. The association must carefully balance their obligation to protect the common property and the unit owners with the rights of the owners for a reasonable expectation of privacy. In placing security cameras, the association is obligated by law to post signs notifying anyone that the area is under security camera surveillance for the protection of the property or the residents. The association also has an obligation to establish who can view the security footage and how it will be used and monitored.
In my opinion, from what you describe your association is clearly both violating the law and your reasonable expectations of privacy.
