Monitoring Board Election Votes

Dennis, Happy New Year
We have a board member election coming up for 2026. So far our election has not ben smooth. There has been issues with the mailing of the ballots to all homeowners.
I have a question regarding the monitoring of the vote count. When the community manger was asked who counts the votes the reply was anyone in the office that is available. Since the integrity of the election is already suspect, who can legally monitor the vote counting if they are not openly counted during the annual member meeting?

    Denise,
    Nothing in current law allows or mandates election ballot monitoring by homeowners. The only right you have is to see all ballots and ballot material after the election is completed. My voting and election bill, SB-1438, will address all of this in several ways, including forcing the association to redo elections if the provisions or expectations are violated. While i can draft the bills and get them sponsored i need the help of all the coalition members to actively support those bills and communicate to the legislators the need for this legislation.
    As a member, you get all my legislative updates. When I ask for help it’s because I need it to get these laws to actually protect all homeowners in this state.
