Ballot ACTION vs ELECTION

Action vs Election.
Ballot for Action item is a FOR or AGAINST choice?
Ballot for Election of director is one box, checked or left blank?
Ballot for Recall of director, an Action item or Election?
Our CC&R’s and Bylaws call out the various Quorum’s but are absent or void on election’s defaulting to ARS 33-1812.

    Joseph,
    You are absolutely correct in your interpretation of Arizona law. For any ballot measure including a recall vote the ballot must allow the voter to vote for or against the measure. In any election the voter gets to choose which candidate they wish to vote for.

    I’ll be proposing legislation this coming year that will establish a standard quorum requirement for all meeting of the members across the state. That standard will be 25% of the votes in the community unless a lower number is specified in the governing documents. My top priority legislation will be focused on elections and ballot measures, to ensure and protect the rights of homeowner to vote and to run for board position without any interference from the board and to ensure the integrity of the election and voting process.

    Happy fourth Dennis!!! Recalling 5 of 5 Directors, petition to call for removal of a member of the board of directors. Do we need to have 5 separate petitions, one for each director? Just how should we do this? We are an off-grid POA of 297 possible votes that we expect to Mail 240 mailers for gathering signatures.

    You can do one petition but you need to name each individual board member that you want recalled. The petition is for the special meeting and not for the removal of the board members. That will happen with the votes at the special meeting.
