Do Bylaw Amendments Have to be Communicated to Owners?

Our Condo Association allows for the bylaws to be amended at a regular or special meeting of the Members, by vote or written assent and of at least a bare majority of a quorum of Members.
Recently, the BOD said our Bylaws were amended back in 201. I have asked for the amended bylaws over a month ago, but I’ve had no response from the BOD or Property Manager. I was hoping to have a “complete” set of governing documents at my disposal. The amended bylaws wasn’t supplied to me at time of purchase of my home. Is there a place for me to find them myself?

    Pamela,

    The bylaws are not recorded and only available for the association. You are absolutely entitled to have a copy of that document and any amendment. The association has 10 business days to make them available to you upon written request. If they fail to comply, they violate the law and are subject to litigation that they will absolutely lose. You could file an ADRE petition for $500 and the association will pay their attorney fees and your application fees when you win the case. They have a choice provide you the document that you requested or go to court and pay all the fees and still have to provide you the documents under court order.
