Political signs and flags
Hey Dennis,
Can you clarify 33-1808 (C) please. Our CC&R’s have nothing regarding political signs or flags. Does 33-1808 (C) define when political signs or flags can be displayed or is it just saying that the HOA can do that.

That statute prevents an association from preventing you from displaying political signs for any primary and general election candidate or ballot measure. It also prevents an association from preventing any homeowner from displaying a for sale sign. So, this is about your ability to post these signs contrary of any restriction that any association has relative to signs. My legislation HB-2158 this session will expand this protection to the ability to post signs relative to community political activity such as election or recall of board members or ballot measures for member approval. This bill will also require associations to allow members to assemble in common property to discuss community issues. This bill will prevent associations from restricting opposition to their positions on issue up to the community to approve and will allow all homeowner the right to actively participate in the governance of their communities and who get elected or remains on the board.

I agree that an HOA should not prevent any political signs/flags from being displayed. Our CC&R’s have no restrictions. Does 33-1808 or any other statute define time limits on the display of political signs/flags or, if there are no restrictions in CC&R’s, can political signs/flags be displayed any time throughout the year? Can I have a sign or flag in my yard now expressing my support for a candidate in the 2024 general election? Are there any statutes limiting the height of a flagpole?

Please read the statute it is very clear about time limits and flagpoles. If you do not know how to use the AZleg.gov web site to find the statutes just google ARS-33-1808 and you will get the text of that statute. Specifically, it allows an association to create rules regulating the size of the flagpole but cannot restrict the installation of a flagpole. The statute also prescribes the time limit for the posting of political signs before and after an election. You cannot install a political sign now for the 2022 election in HOA’s or anywhere else in this state.
