Clotheslines in AZ?

I understand that Arizona has laws allowing for solar devices. My HOA has wording in it’s CCRs that say clotheslines are not allowed unless completely concealed from view. They also do not allow fences higher than 6 feet. Can they prohibit me from putting up a clothesline in my backyard that can be seen from a large distance? Our homes are estate lots, with each lot being well over 1 1/2 acre. What state statues allow clotheslines if they press the issue? Thanks!

    Mary,
There are no state laws that address clotheslines. The exact wording of your restrictions and definitions are important here. If the only wording is visible that can be reasonably assumed to mean from the street or common property. So, if your clotheslines are visible to from the street by a normal height individual they would be prevented. But if your restriction includes neighboring property than they would be prohibited if they could be seen while standing on neighboring property grade. A 6 ft fence would block the view from any neighboring property. While there could be many possible issues with the differences in grade between property any interpretation that expanded that provision based on elevation changes would be considered unreasonable, especially from any appreciable distance.

I’ve never heard or the “right to dry”. if you mean clothes lines, I know of no state statute that requires Association to allow people to have clothes lines.
