Assessments different for members
When the 20 year old HOA was established, significantly lower monthly assessments were established for a few streets “outside” the securty gates. These owners are allowed to use all amentities. Now streets need complete replacement. Their dues will not come close to covering the cost. There rest of us will pay for their streets. Attorney says due to developers intent: “The owners themselves are welcome to try if they really want, though. That would involve the owners hiring their own legal counsel to prepare an amendment. Then, they would need to follow the procedure in Section 14.2 of the CC&Rs to get the rest of the community’s unanimous approval of the amendment.” This feels like an unfair burden. I’ve asked if they can get a special assessment or something to make it fair.
