Conversations with Insurance Agent
Good Afternoon Dennis
My question pertains to HOA insurance. Is the individual homeowner able to have a conversation with the HOA insurance agent? The purpose would be to bring to the agent’s attention the condition of a portion of the property that has had no money allocated to its care and, thus, has not been properly maintained and currently poses a liability to residents who live here.

I’m not sure why you would want to do that? Because the contract is between the association and the board unless you were filing a claim against the insurance policy, homeowners have no rights to discuss anything with the insurance company. If you were able to bring information up to the insurance company that would cause the company to re-consider their risk and either drop the association or raise the rates for the association policy. In either case the homeowners lose. The insurance company will not do anything to change how the association manages its community, they will simply drop out. The association would then have a cause of action against you, for causing the insurance company to drop their coverage of your community.
Your issue is with your board, keep it there and don’t shoot yourself in the foot by trying to get somebody else to do your work for you. Organize your community to insist that the association do its job in maintaining the community.
