VOTE CONFIRMATION/AUDIT

Hi Dennis, our assocation just bought a building and property to add onto our Sun City Oro Valley Community footprint. I should say it’s got an accepted LOI, but also another Buyer who claims they had the property tied up with accepted LOI and and exclusivity clause is now suing the Seller. Meanwhile our Assocation pressed on spending money on inspections and fast tracking a vote requiring a simple majority. It was very contentious and many lies were told to us. I can count on two fingers the people I know who voted for it and it wasn’t even close…the “FOR’s” have it. A legal opinion we got on the lawsuit says it is very serious and could likely be tied up for years.

DO I AS A HOMEOWNER HAVE THE RIGHT TO REQUEST DOCUMENTATION SHOWING THE VOTES WHICH THEY CAN SHOW WITH JUST OUR SPECIFIC AND UNIQUE VOTER ID CODE/registration? (my confirmation):

I would sure like to see a list of just the “registration” numbers and the vote. I know at least one person who voted by mail and I believe some may have voted by phone which may not be allowed. Can I request this and how would I do so and would they be required to provide it? It would not be very hard to compare with several people I know to see if this was legit which many of us do not think it was.

I also saw a review online of Carpenter Hazlewood that said that law firm helped their association cheat on an election. It has since been removed. Vote-now.com, our Board, and Carpenter Hazelwood are all member of the CAI organization and I can find very little info on Vote-now.com, no one to talk to either.

    Marcia,
    The association is required to retain the ballots and records of all people that voted but not necessarily together. If you utilize secret voting that the two cannot be connected but if you do not you must be able to see the record of every vote. Voting by phone and utilizing an unregulated on-line system is not allowed. These records must be retained for one year and made available to any homeowner upon request.
    Ask to view the record of all ballots submitted on the issue and who submitted ballots in this election. They have 10 days to provide you access to those records.
    I have proposed legislation that will clarify all these existing requirement and prevent attorneys like CH from distorting and abusing these laws. I don’t have a sponsor yet and could use your help to contact your legislators and ask that they have they assistants set up meeting so that I can explain these proposal to them.
