Vetting Process
Hi Dennis
Is it proper for an HOA board for a planned community to protect the following information:
– the names of attorney groups solicited by the management company on behalf of the Board to receive a legal opinion on a matter that has been discussed openly by the Board for months (forming a subAssociation)
– which attorney group the Association chose to hire for that purpose
– and what the criteria were that were used for the decision-making

While any advice received from an attorney including the basis for that advice is privileged and protected information the name of the attorney or law firm contracted and used by the association is not. Who the association chose to solicit for contracted services is not protected but is also irrelevant to any homeowner, it’s not like there are deals out there in attorney services. They are all expensive and, in my opinion, when it comes to HOA’s they are all crooks.
