BOD election
Dennis,
We’ve had some turnover in our association and differing interpretations on voting for BOD. Our declarant states we elect 3 directors.
1) on our current ballot we have 4 people who are running for 3 BOD positions. Currently our ballot says each unit may vote for up to 3 people to fill the vacancies. One new member said that isn’t right. Each unit gets to vote for only 1 person.
2) please clarify if a husband and wife jointly own a unit, does that unit get 2 votes and a single owner gets only 1 vote?
Concerns from each side are: if there is only 1 vote per unit, we potentially may have only 1 or 2 directors elected. , on the other hand if we are allowed to vote for up to three, someone’s concern is, we could “rig the election”. (They both mention“Robert’s Rules”.) if there is a tie, do we do a runoff?

Each home gets one vote on any issue to be decided by the members. If a home has more than one person listed on the title than either of the parties can vote but not both. In the case of your specific election, you have three positions open for election, so each home gets one vote for each position open. So, each home can cast a vote for any three of the candidates on the ballot and if your bylaws allow you can cast one or more of those votes for write-in candidates. This is absolutely no different for any other election in government where more than one position is open, like a city council or a school board. You get to vote for how many open positions there are.
