Win at the AZ Office of Administrative Hearings

We won two issues on June 21, 2023, after a three-hour hearing. First, we won the fact HOA Committees must complete meeting minutes. Our HOA even after the ruling says they do not have to do minutes because the Committees are not member meetings. We argued that to be on a committee you must be a member in good standing and if you must be a member they are member meetings. Second, the HOA has refused to provide supporting tax documents. The provided two pages of the 1120-H filing and part of a General Ledger that was given to the CPA as the sole documentation for the tax filing. As a retired federal agent who did significant financial fraud cases that had criminal tax charges, I know everything they have been say in wrong. It the old garbage in garbage out principle with CPAs. They will always say they rely on what they are given. We started our request in November 2023, and only after pushing and getting with a supervisor we find six months later there are roughly 7000 pages of supporting documents. The Judge ruled in our favor under ARS 33-1805, the failure to provide “all financial records” within ten days. We now understand the Petition process. This was the Judge’s first case.

Congratulations on your victory. I’m pleased to hear of your victory; I’ve lost all faith in the administrative law judges and their agency for the last two years, and I’ve told the agency director that to his face. Maybe things are changing and my criticism has taken affect.
