Board Meeting Minutes Availibility
Hi Dennis,
Our board of directors regular meeting are quarterly. My question is when should a member be able to request meeting minutes after a regular board meeting? Our management co. says they will not send out minutes that have not been approved, which occurs at the the next regular board meeting. That puts the availability of meeting minutes up to three months or more. Are there any governing statutes etc. that can be applied to a situation like this.. Waiting 3 months or more seems more like a stall tactic. What can you suggest in a situation like this?

This is a problem experienced throughout the state. The associations hide behind the records request statutes because meeting minutes are not official records until approved by the board. The issue is transparency. There is absolutely no reason why draft minutes cannot be made available to help homeowner that were not present in the meeting know what the board is doing. I’ve tried to get this into statute for several years now and will try again this coming year..
board do not want homeowners to know what they are doing so they use any method available to delay providing any information on their actions as long as possible. Getting to see what the board decided three months a go as official records is absolutely ridiculous. The actions are effective immediately nd the homeowner have a right to know and understand the actions of the board immediately.
You can undermine this secrecy attempt by actually attending the meetings.or having one person attend and record the meeting for everyone to share.
