Disclosure of Legal Fees
Our HOA spent over $6,000 on legal fees to prevent a homeowner from adding a railing.gates to their patio. The homeowners request was eventually approved because it met all of the HOA requirements. One Board Member has a personal beef with the Homeowner requesting the approval of the railing/gates and did all he could to prevent them doing the installation. I have requested that the Board share details of the legal fees that have been spent YTD. They have refused to do so claiming they do not have too. I have requested copies of the invoices and have been denied. Is this information allowed to be shared with the community?

The association must provide any homeowner the opportunity to view any record of the association, especially financial records. Any invoice for any service is a record of the association subject to these record requests. While legal advice from an attorney is privileged, the bill for those services is not. Legal bills are no different from bills from landscapers.
