Violation Open Meeting Request
When I request an Open Meeting to Appeal my Violation Notice, can I request it to be a Open Executive Meeting separate from Regular Board Meetings or can they put it on the Regular Open Board Meeting Agenda mixed in with other items?
Can they limit my time to speak to 3 min and Not allow me to respond to board members at this hearing?
Can I insist on a In Person Board Meeting rather than Zoom because our President is always cutting people off and not allowing them to speak on Zoom.

You have the right to ask for your hearing to be held in either an open session or a closed session. After that, the association is free to conduct that hearing any way they want. You must be provided with your opportunity to present your appeal, and the usual restriction for speaking at a regular board meeting does not apply. While nothing in current law specifies that what is essential to focus on is that the board must provide you with a reasonable opportunity to present your case or to give testimony from other homeowners. Currently, no law allows a board to hold a meeting virtually, and doing so without compliance with all the provisions for an in-person meeting would violate the law. Because that tool allows the association to censor free speech does not mean that they can do that any more than they can in an in-person meeting.
