Address Change on Design Guidelines

Hi Dennis,
Reviewing our association docs. The Design Guidelines document states: “Application and plans (which will be kept on file with the Association) should be sent to: Our HOA c/o the terminated Management Co” same thing for “Appeals”.

Can I update this to our new address? (We have 2 sales pending.) Does it have to go to the Board for approval?

    Brenda,

    This is a record keeping issue and does not need board approval to do so, but you should update the design guideline and that approval requirement will be specified in your governing documents, some require board approval some only require ARC approval. If you are reviewing your design guidelines and want to make some editorial changes you may want to conduct a review of your documents to make sure that it defines the requirements that you actually want to maintains for your community. They must include any specific standard specified in the CC&R’s but after that the details are up to you and must be reasonable and directly related to maintaining the property value of the homes in your community. Anything else is up to you and if excessive and unreasonable could be challenged by any homeowner.
