    In a condominium the CC&R’s define what is common property and what is not. While most condominiums have the electrical, plumbing and HVAC services within the common property and therefore the responsibility of the association to maintain some CC&R’s dictate otherwise. While their is a provision in state law relative to this issue that would result in a different answer to this question that provision would have to be allowed by the CC&R’s and apply responsibility for common area maintenance to other than all unit owners. If your CC&R’s apply responsibility for common expenses to all unit owners in proportion of their ownership rights than this provision in statute does not apply to your association. Anything within the common property is a common expense to maintain and not the responsibility of the unit owners to maintain.
