Secret Ballots

Hi Dennis,
re secret ballots. Is it necessary to have a ballot placed inside an envelope inside another envelope which the homeowner signs, then all of that placed inside another envelope which is mailed to the homeowner. We mailed an envelope (which had signature lines) and a ballot inside the envelope mailed to the homeowners. Two people got all upset that there wasn’t another envelope inside to put their ballot in. I see nothing in the ARS or anywhere that actually specifies this procedure. (Our CCR’s specify secret ballots but not a “procedure”) We do have observers making sure no one views the ballots when they are removed from the signed envelopes.
Having 3 envelopes seems like overkill to me – this isn’t a Presidential Election – we don’t even do that for a national election.

    Dave,
    The only requirement in statute is that either ballot or the envelope containing the ballot be signed if the election is secret. That is the law, but the law has very little control on stupid. Why anyone would thing that three envelopes is required or even reasonable is totally beyond me. If you signed the envelope that the ballot is mailed in and identified your address or lot number on that envelop that would be all that is required by law.
