Board Election Tampering

Our POA Board and the Property Management Company did not provide hard copies of Candidates statements to each owner in the Ballot mailing or at any time to control what our non-email owners see, which is about half of owners. The POA had previously sent out a hard copy letter from the President campaigning for the current board while denigrating new ones running. They are controlling what info what these non-email owners see. We only have a few weeks before the election and ballots will be filled out and returned by owners as we speak.

Is sending the ballots out without candidate statements illegal or ethics violation?

    Cindy,
    Nothing in law addresses publishing candidate information distribution; if it is regulated, it will be from your bylaws. But for any sitting board member to use association funds to promote their election but not provide equal access and opportunity to all other candidates is totally unethical. I actually had language to that effect in my voting bill but the trade organization convinced the sponsor that everyone knows that doing that is improper and was not required in statutes. It still contains provisions relative to board communications in support of any other ballot initiative. That bill should be introduced either today or tomorrow.
